SHOULD I PLEAD GUILTY?

When you plead guilty, you are essentially admitting the allegations against you. You are forfeiting your right to a trial, and relieving the crown of its burden of proof. Guilty Plea, means that you are admitting (in open court) to the facts that form the basis of the police allegations against you. Before pleading guilty it is essential that you understand and consider the following consequences.

  • What sentence (punishment) is the crown seeking on a guilty plea? Do they want to put you in Jail? and/or Probation?
  • What other orders is the crown seeking? Driving Prohibition, Weapons Prohibition, DNA order. Etc. / and their implications.
  • How will a finding of guilt? Or Criminal record ? impact your future employment prospects?
  • How will it impact your ability to travel abroad?
  • How will it impact your immigration status?
  • How will it impact any other court proceeding such as family law proceeding or civil proceedings?
All too often accused plead guilty “just to get it over with” without understanding the full consequences of their plea.
